WAIVER

Inc consideration of being permitted to participate in the 3 on 3 Basketball Tournament and Family Fun Day at Mill River Park, and in view of the risks inherent in such activity, the undersigned participant (the “Participant”) executes this Release and Indemnification Agreement.

 

Participant recognizes that certain hazards and dangers are inherent in the participation in the 3 on 3 Basketball Tournament and Family Fun Day at Mill River Park and Participant is familiar with all such risks associated with participation in the 3 on 3 Basketball Tournament and Family Fun Day at Mill River Park.

 

Participant recognizes, understands, agrees to, and has instructed his/her child/children to follow the rules and regulations of the 3 on 3 Basketball Tournament and Family Fun Day at Mill River Park, as the same are adopted from time to time.

 

In further consideration of Participant being allowed to take part in the 3 on 3 Basketball Tournament and Family Fun Day at Mill River Park, Participant hereby agrees to release and waive and to indemnify and hold harmless, The Ryan Patrick O’Shea Foundation, its officers, trustees, coaches, employees, and agents from any claims of any nature whatsoever arising out of, or in any way relating to the activities thereof and Participant’s use of the facilities of Mill River.  The foregoing release, waiver and indemnification shall apply to, without limitation, participation in the 3 on 3 Basketball Tournament and Family Fun Day at Mill River Park and include but are not limited to claims by other Participants who may be injured or damaged as a result of Participant’s conduct.

 

The term “Participant” as used herein shall include the undersigned, any child whom the undersigned, as parent or guardian, allows to participate in the 3 on 3 Basketball Tournament and Family Fun Day at Mill River Park, and any and all children, heirs, next of kin, assigns and personal representatives of any of them.
